WEBSITE AGREEMENT

 

TERMS OF AGREEMENT:  This is an agreement between you, the user of the SteelRoofingSales.com website (“Website”); and the owner of the Website (“Company”). The following is a list of the terms and conditions (“Terms”) to which you agree by browsing our Website or purchasing any items off this Website.  The Company reserves the right to change the Terms at any time by notification of the changes on the Website. You agree that your continued use of the Website shall constitute your acceptance of such changes.

WEBSITE PAYMENT:  Credit and debit charges may be made using Visa, MasterCard, Discovery and Paypal.  If we are unable to charge your card successfully, we will notify you so that you can update your card information and/or authorize payment from another credit or debit card.  If payment is unsuccessful more than one, or the order is more than 3 days old without payment, the order will be canceled.  If this occurs, please feel free to place another order.  If payment is successful, your card will be charged at the time of purchase. The Company has no means by which to alter or revoke a credit card charge for an order after it has been submitted. The Company is not obligated to honor any credit or debit card presented to it and may refuse the same, in its own sole discretion.

WEBSITE SECURITY AND DATA PROTECTION: All credit card numbers are encrypted in the software when the order is placed using 128 bit SSL encryption.  Our encryption technology secures information as it is transmitted over the Internet, preventing an unauthorized party from viewing and downloading your information. Your credit card and other personal information will not be sold or distributed to other companies.  We protect our databases with various physical, technical and procedural measures and we restrict access to your information by unauthorized persons. Our information systems are maintained behind a software firewall to isolate them from access by other networks connected to the Internet. We also advise all our employees about their responsibility to protect customer data and we provide them with appropriate guidelines for adhering to the Company's business ethics standards and confidentiality policies.  All information transmitted through the Website is stored on our secure server.

PRICE AND STOCK: We take pride in being very competitive with our prices.  However, should a product price be listed incorrectly for any reason, we reserve right to refuse or cancel any orders for the product at the incorrect price.

 

SHIPPING: All orders ship via UPS, USPS, FedEx within continental USA 48 states only. The choice of carrier is at the discretion of SteelRoofingSales.com. Once your order has been shipped, we will send a confirming email with a tracking number.  Company is responsible for loss or damage to the goods intransit to you.

 

DELIVERY:  It is your  responsibility to sign for the goods upon receipt from the carrier.  Your signature confirms that the goods have been received in satisfactory condition.  If you delegate this responsibility to any other person we will not be liable for any loss or damage of the goods that may later be discovered.

RETURNS:  Authorization must be obtained from SteelRoofingSales.com for the return of merchandise. All requests for returns must be made within 3 working days of receipt of merchandise. Credit is not allowed on worn, misused products, or open box items. Returns must be sent freight prepaid. Restocking charges of 25% will apply to all returns. You are responsible for loss or damage to goods being returned to Company.

ADVERTISERS:  The Company is not responsible or liable for any losses or damages associated with your correspondence, business dealings, promotions or other participation with advertisers found on or through the Website, including payment and delivery of goods or services, and all other terms, conditions, warranties or representations associated with such dealings.

WARRANTIES:  YOU CAN PURCHASE WITH CONFIDENCE BECAUSE ALL MANUFACTURER WARRANTIES WILL APPLY TO PRODUCTS PURCHASED THROUGH THE WEBSITE.  ALL MANUFACTURER WARRANTIES ARE THE SOLE RESPONSIBILITY OF THE MANUFACTURER, AND YOU MUST CORRESPOND WITH AND SHIP DIRECTLY TO THE MANUFACTURER WITH RESPECT TO SUCH WARRANTIES. THE COMPANY MAKES NO EXPRESS OR IMPLIED WARRANTIES OR GUARANTEES WITH RESPECT TO ANY GOODS OR SERVICES PURCHASED ON THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF ANY RIGHTS OF OTHERS OR ANY WARRANTIES AS TO THE RESULTS TO BE OBTAINED BY YOU OR ANY OTHER PERSON BY USING GOODS PURCHASED ON THE WEBSITE. 

LIMITATION OF LIABILITY:  COMPANY IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE, DIRECT OR INDIRECT, ARISING FROM ANY INACCURACY OR INCOMPLETENESS IN, OR DELAYS, LOSS OR CORRUPTION OF THE WEBSITE, INTERRUPTIONS, ERRORS OR OMISSIONS IN THE INFORMATION OR CONTENT ON THE WEBSITE, OR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON ANY INFORMATION OR CONTENT PROVIDED ON THE WEBSITE.  COMPANY IS NOT LIABLE FOR ANY LOSS OF REVENUES, LOST PROFITS OR ANY PUNITIVE, INDIRECT, COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR SIMILAR DAMAGES CLAIMED BY YOU OR OTHERS, INCLUDING BUT NOT LIMITED TO BODILY INJURY, EMOTIONAL DISTRESS OR ANY OTHER DAMAGES WITH RESPECT TO GOODS OR SERVICES PURCHASED ON THE WEBSITE.  IN NO EVENT SHALL THE LIABILITY OF THE COMPANY EXCEED THE AMOUNTS PAID BY YOU FOR SUCH GOODS OR SERVICES.

COMPLAINTS:  You may submit any complaints you may have regarding the Website by clicking on the “Contact Us” button or by emailing us at the address given therein 

 

COPYRIGHT/ TRADEMARKS: The Company owns all rights in the Website format, designs and layout, as well as all information on the Website provided by the Company, all of which are protected by copyright, trademarks and other intellectual property rights.

 

DELIVERY TERMS FOR $100 FLAT FEE SHIPPING:

• Please note the following terms and conditions required for delivery. In some areas there are restrictions prohibiting delivery. Additional delivery fee may apply for jobsites that extend 25 miles beyond a main highway. Your customer service profesional will contact you prior to processing your card with a delivered total.
• Machinery is required in most areas to properly and safely unload your material.
• You are responsible of the cost and acquisition of such machinery Ex: using a forklift is probably the best way to unload the material. Check your local rental center for availability. Our driver will call you with advanced notice in order for you to be ready for unloading.
• In some areas the delivery truck will have the ability to unload the material for you. All material is unloaded to the ground. Rooftop delivery is not available.
• Your order will be delivered on a semi tractor trailer combo in the excess of 70' long. This requires sufficient space to get in and out of your job. The driver has the sole discretion of this decision. Unfortunately your order may not drop in the exact area that you require. Please be aware we will do everything possible to serve you well. The limitations of the truck will decide the availability for each drop area.
• A jobsite delivery form will be required from you prior to ordering and processing you job. This form will be provided after the checkout transaction.
• I understand and accept the deliver terms as stated. I agree to pay for additional costs involved in delivers that are scheduled to an incorrect address or if the address scheduled is not the actual jobsite. Any changes that are needed are required to be made by you to us prior to the load date of your order. Once the truck is loaded the schedule cannot be changed.
